KATHMANDU – The high-level judicial commission, led by Gauri Bahadur Karki, has recommended stringent legal action against former Prime Minister KP Sharma Oli, former Home Minister Ramesh Lekhak, and Inspector General of Police (IGP) Chandra Kuber Khapung for their roles in the suppression of the Gen-Z uprising on Bhadra 23 and 24.

The 907-page report, which was recently made public despite government hesitation, provides a detailed account of the state’s response to the youth-led protests. The commission has categorized the nature of the crackdown as a severe violation of human rights and democratic norms.  

Key Highlights of the Report:

• Recommended Penalties: The commission has called for legal proceedings and departmental action ranging from three to ten years for top leadership and security heads.

• Individuals Named: * KP Sharma Oli: Cited for executive overreach and failure to prevent lethal force.

• Ramesh Lekhak: Held accountable for the Home Ministry's direct orders during the escalation.

• Chandra Kuber Khapung: Criticized for the police department's tactical failures and the use of "above-the-waist" firing protocols.

• Scope of Investigation: The report includes evidence from over 7,000 pages of annexures, including digital footprints from social media, forensic reports of the deceased, and testimonies from injured protesters.

• Government Stance: While the current administration under Prime Minister Sushila Karki has received the report, the public release comes amid growing pressure from civil society and Gen-Z activists demanding immediate implementation.

The "Gen-Z" Context

The uprising, which occurred on September 8–9 (Bhadra 23–24), was sparked by digital censorship and long-standing grievances against political nepotism. The Karki Commission concludes that the state's "disproportionate and violent response" turned a peaceful protest into a national tragedy, resulting in significant loss of life.

The report serves as a landmark document in Nepal’s judicial history, marking the first time a commission has explicitly recommended criminal and administrative penalties for a sitting Prime Minister and Home Minister regarding crowd control measures.

काठमाडौँ – २०८१ भदौ २३ र २४ गते भएको 'जेन–जी' (Z-Generation) आन्दोलनको छानबिन गर्न गठित गौरीबहादुर कार्की आयोगले आफ्नो प्रतिवेदन सार्वजनिक गर्दै तत्कालीन उच्च पदस्थ अधिकारीहरूलाई कडा कारबाहीको सिफारिस गरेको छ।

आयोगले बुझाएको ९०७ पृष्ठको विस्तृत प्रतिवेदनमा तत्कालीन प्रधानमन्त्री केपी शर्मा ओली, गृहमन्त्री रमेश लेखक र प्रहरी महानिरीक्षक (IGP) चन्द्रकुबेर खापुङसहितलाई दोषी ठहर गर्दै ३ देखि १० वर्षसम्मको कारबाही गर्न सिफारिस गरिएको छ।

प्रतिवेदनका मुख्य बुँदाहरू:

• दोषी ठहर: प्रतिवेदनले आन्दोलन दबाउन अनावश्यक बल प्रयोग गरिएको र मानव अधिकारको गम्भीर उल्लंघन भएको निष्कर्ष निकालेको छ। यसमा तत्कालीन राजनीतिक नेतृत्व र सुरक्षा निकायको नेतृत्वलाई मुख्य जिम्मेवार ठहर्‍याइएको छ।

• कारबाहीको प्रकृति: घटनाको गाम्भीर्यता हेरी तत्कालीन प्रधानमन्त्री ओली, गृहमन्त्री लेखक र आईजीपी खापुङलाई कानुन बमोजिम ३ देखि १० वर्षसम्मको कैद वा विभागीय कारबाहीको सिफारिस गरिएको छ।

• प्रतिवेदन सार्वजनिक: सरकारले प्रतिवेदन कार्यान्वयन गर्न अलमल गरिरहेका बेला मंगलबार यसका मुख्य अंशहरू सार्वजनिक भएका हुन्। आयोगले ९०७ पृष्ठको मुख्य प्रतिवेदनसँगै करिब ७ हजार पृष्ठका अन्य प्रमाण र अनुसन्धानका कागजातहरू पनि संलग्न राखेको छ।

• विद्रोहको पृष्ठभूमि: भदौ २३ र २४ गते युवा पुस्ता (जेन-जी) ले सामाजिक सञ्जालमा लगाइएको प्रतिबन्ध र राजनीतिक बेथितिको विरुद्धमा गरेको प्रदर्शनमा राज्यले गरेको दमनका कारण ठूलो क्षति भएको थियो।

सरकारको अन्योल

प्रधानमन्त्री सुशीला कार्की नेतृत्वको वर्तमान सरकारलाई यो प्रतिवेदन कार्यान्वयन गर्न ठूलो दबाब परेको छ। प्रतिवेदनले सुरक्षा निकायमा भएको 'चेन अफ कमाण्ड' को दुरुपयोग र राजनीतिक हस्तक्षेपलाई स्पष्ट रूपमा औंल्याएको छ।

यो प्रतिवेदन सार्वजनिक भएसँगै नेपालको राजनीतिक वृत्तमा नयाँ तरंग पैदा भएको छ। विशेषगरी तत्कालीन सत्तापक्ष र सुरक्षा निकायका अधिकारीहरूमाथि हुन सक्ने कानुनी प्रक्रियालाई लिएर नागरिक समाज र युवा अधिकारकर्मीहरूले कडा निगरानी गरिरहेका छन्।
